Fixed punishment or Flexible one?

Some people believe that there should be a fixed punishment for each type of crime. Others, however, argue that the circumstances of an individual crime, and the motivation of committing it, should always be taken into account when deciding on the punishment.

Discuss both views and give your own opinion.

Opinions differ on whether every category of offences should have a designated punishment, or illegal actions should be taken case-by-case to determine the appropriate sentence. Personally, I believe having a fixed punishment is necessary for minor offences, while serious crimes should have specific consideration for each case.

On the one hand, having one set of punishment for every crime is advocated because of several reasons. Firstly, this approach could provide a fair and clear justice system to deter criminals. Everyone knows exactly and precisely the punishment for each crime, so they might be aware of not committing offences. Secondly, having arranged sentences we support the ministry of justice to lessen the pressure of handling criminal cases while ensuring security and fairness to the society. I think this method will work best for punishing minor crimes, such as pickpocketing, or shoplifting because their motivated reasons are simple and consequences are not as severe as the other serious crimes. 

On the other hand, I believe that the circumstances of the crime and a criminal’s motivation should play a certain role in deciding the punishment for serious crimes. The first reason for this is to provide a more humane justice System. For instance, a person stealing to feed a family should be punished differently compared to someone stealing for his or her own benefit. In addition, fixed punishments are hardly applied to several complicated criminal cases because they require thorough inspections. Judges, therefore, Play a significant role in this case-by-case method, in which they will decide the most suitable punishment in accordance with the motivation and circumstances of the criminal case.

In conclusion, it seems to me that applying a set of sentences for each crime and having a case-by-case criminal solving process are all necessary depending on offence levels. Low-level crimes should be sentenced by fixed punishment while the penalty for high-level crimes should be judged individually.
